1.- Ownership of the Website
In accordance with the provisions of article 10 of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (hereinafter, "LSSI"), we inform you that the website www.hellobb.net (hereinafter, "Website" or "Portal") is managed by HELLOBB S.L. (hereinafter "HelloBB"), with C.I.F B-09621285, with registered office at C/ Pompeu Fabra 36, 4º 6ª , CP:43500, Tortosa, Spain.
2.- Use of the Portal
This Legal Notice (hereinafter, "Legal Notice") establishes the conditions that regulate the use of the information society services that HELLOBB makes available to users through the Website. The aspects related to the processing of personal data of users due to the use of the Website are regulated by the Privacy and Cookies Policy.
Therefore, access to and use of the Website implies that the user (hereinafter, "User") fully accepts and undertakes to comply with this Legal Notice, the Privacy Policy, as well as the instructions or recommendations provided in each specific case.
Access to the Website is free, except for the cost of connection through the telecommunications network provided by the access provider chosen by the User.
HELLOBB reserves the right to make, at any time and without prior notice, changes and updates to the Website and its contents, configuration and presentation, including this Legal Notice, so it is recommended to read it before each access and navigation on the Portal.
The User undertakes not to use the Website for fraudulent purposes, nor to carry out any action that may damage the image, interests and rights of HELLOBB or third parties, undertaking to use the Portal, the services and the contents included therein in a diligent, correct and lawful manner. In particular, the User undertakes to refrain from: eliminating, evading or manipulating the "copyright" and other identifying data of the rights of the owners incorporated into the contents of the Portal, as well as the technical protection devices or any information mechanism that may include such contents. Likewise, the User undertakes not to carry out actions that may damage, disable or overload the Website, or that impede, in any way, the use and normal functioning thereof.
In the event of a breach of this Legal Notice, or if HELLOBB reasonably suspects that this is happening, HELLOBB reserves the right to limit, suspend or terminate access to the Website, adopting any technical measure necessary for this purpose. Furthermore, HELLOBB reserves the right to decide, at any time, on the continuity of the services provided through the Portal.
3.- Intellectual and industrial property
The intellectual property rights on the layout of the contents of the Website (including the right to databases), the graphic design (look & feel), the distinctive signs (brands and trade names), the underlying computer programs (including source codes), as well as the different elements that make up the Portal (texts, graphics, photographs, videos, etc.) belong to HELLOBB or to third parties who grant their use and exploitation, and in this sense they constitute works protected by the legislation in force on intellectual and industrial property.
The use of the Website by the User does not imply in any way the transfer of intellectual and/or industrial property rights on the Portal, its contents and/or the distinctive signs of HELLOBB. To this end, with this Legal Notice, except in cases where it is legally permitted, the User is expressly prohibited from reproducing, transforming, distributing, publicly communicating, making available, extracting and/or reusing the Website, its contents and/or the distinctive signs of HELLOBB.
The reproduction of elements or contents of the Website for profit or commercial purposes is expressly and strictly prohibited.
4.- Limitation of Liability
The User acknowledges and accepts that the use of the Website is at all times at their own risk and responsibility, so HELLOBB assumes no responsibility for improper or incorrect use of the Portal. To this end, HELLOBB will only be liable for the damages that the User may suffer as a result of the use of the Website, when such damages are foreseen by current legislation.
In particular, HELLOBB will not be liable for:
The content of the sites connected through the links included in the Website. In this regard, the terms set out in section 5 of this Legal Notice apply.
Damages of any kind caused to the User's computer equipment by viruses, worms, Trojans or any other harmful elements. The User acknowledges that the use of the Internet carries the risk that their computer equipment may be affected by the aforementioned elements. To this end, it is the User's responsibility, in any case, to have the appropriate tools for the detection and removal of harmful electronic programs.
Damages and losses of any kind caused to the User arising from failures or disconnections in telecommunications networks that cause the suspension, cancellation or interruption of the Website service during the provision of the same or previously. In this regard, the User acknowledges that access to the Portal requires services provided by third parties outside the control of HELLOBB (for example: telecommunications network operators, access providers, etc.) whose reliability, quality, continuity and operation are not the responsibility of HELLOBB.
5.- Links
The Website may include technical connection devices (links) that allow the User to access other pages and portals on the Internet (hereinafter, "Linked Sites"). In these cases, HELLOBB acts as a provider of mediation services in accordance with article 17 of the LSSI and will only be responsible for the contents and services provided on the Linked Sites to the extent that it has actual knowledge of their unlawfulness and has not deactivated the link with due diligence. If the User believes that there is a Linked Site with unlawful or inappropriate content, please notify HELLOBB via hola@hellobb.net. Under no circumstances will such communication imply the obligation to remove the corresponding link.
The existence of Linked Sites does not imply in any way that HELLOBB has actual or other knowledge of the services and contents of the same in case of unlawfulness, nor that it necessarily maintains agreements with those responsible or owners of the Linked Sites. Nor does it imply that the existence of such links entails recommendation, promotion, identification or approval by HELLOBB of the statements, contents or services provided through the Linked Sites. Consequently, HELLOBB is not responsible for the content of the Linked Sites, nor for their conditions of use and privacy policies, the User being solely responsible for checking and accepting them each time he or she accesses and uses them.
The User and, in general, any natural or legal person who intends to establish a link from their page or site to the Portal, must obtain prior written authorization from HELLOBB. The establishment of such a link does not imply in any case the existence of relations between HELLOBB and the owner or proprietor of the site or page on which it is established, nor the acceptance or approval by HELLOBB of its contents or services.
In any case, HELLOBB reserves the right to prohibit or disable at any time the links to the Website, especially in the event of the unlawfulness of the activity or contents of the page or site in which the link is included.
6.- General
The use of the Website is governed and interpreted in accordance with Spanish law and it will be understood that, by using the Portal, the User accepts that any conflict or dispute that arises between the user and HELLOBB will be dealt with by the competent courts in accordance with the applicable legislation.
If any of the provisions contained in this Legal Notice are declared null, they will be removed or replaced. In any case, such declaration of nullity will not affect the validity of the remaining provisions contained in this Legal Notice.
